Terms of Service

1. Acceptance of Terms
By accessing or using Nevala (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
2. Service Description
Nevala is a commercial tool that scans video, image, and page content for specific user-selected phobia triggers using AI. Users select a phobia, then submit a YouTube link, a video file, or an image — or scan ahead on a page in their browser — and receive a timecoded trigger map for video or a verdict for images. The Service is delivered via a Chrome extension and supporting website.
3. Eligibility
You must be at least 16 years old to use the Service. You represent that you have the legal authority in your jurisdiction to accept these Terms.
4. Account Registration
Authentication is provided via Google OAuth. You agree to provide accurate information and to maintain the security of your account credentials. You are responsible for activity that occurs under your account.
5. Acceptable Use
You agree not to:
- Upload or process illegal content, including child sexual abuse material (CSAM), non-consensual intimate imagery, or content that infringes copyright, trademark, or other rights
- Reverse engineer, scrape, or abuse rate limits of the Service
- Create multiple accounts to evade rate limits or credit exhaustion
- Resell Nevala scans as a service to third parties
6. Payment Terms
Nevala is a paid product. Access requires a one-time $12 unlock, which includes 1,560 starter credits (about 5 hours of video on the default quality tier). Additional scanning is billed in credits through optional top-ups ($5 → 5,000 credits; $10 → 10,500 credits with a 5% bonus; $25 → 27,500 credits with a 10% bonus). There is no subscription. Prices are listed in USD; Paddle localizes for your region.
Scans are billed at variable cost: each scan’s credit cost is the actual AI compute cost (Google Vertex AI) to process your content, multiplied by 1.30, and an estimate plus a maximum are shown before each scan. There is no fixed per-minute price. Credits for an image scan cover the AI compute plus the brief upload and storage during scanning; there are no separate fees for those components.
Per-scan cost depends only on the content’s length and complexity and the quality tier you select — the same rate applies to every user. We do not personalise prices based on identity, location, device, browsing history, or any user attribute.
Payments are processed by Paddle.com, acting as Merchant of Record. Paddle handles all taxes (including VAT and sales tax) and payment disputes.
7. Credit Balances
Credits are denominated in a single unit usable across all scan types (video, image, page). Credits never expire. Each purchase issues its own credit lot; we consume credits FIFO from the oldest un-exhausted lot, so you don’t need to track lots manually. We do not charge inactivity, dormancy, or maintenance fees.
8. Refunds
Every purchase — the $12 unlock and any top-up — is refundable on its unused base credits, pro-rata. If you have started no scan against a purchase, it is fully refundable within 110 days. Once you start scanning, the credits a completed scan consumes are non-refundable, while your remaining unused base credits stay refundable — pro-rata, calculated as dollars paid × (unused base credits ÷ base credits granted) — until those base credits are fully consumed. There is no separate calendar cap on that pro-rata right.
Bonus credits (the +5% / +10% promotional credits) are a free goodwill grant with no monetary value; they are not part of the price, are removed rather than refunded when a refund is processed, and refunds are calculated only against base credits.
If you live in the EU/EEA, you expressly request that performance of the AI scanning service begin during your statutory 14-day withdrawal period, and you acknowledge that once you have used all of the base credits in your purchase the service has been fully performed and your right of withdrawal is lost; until then, unused base credits remain refundable on a pro-rata basis. If a refund is granted on one platform (Apple in-app purchase on iOS or Paddle on the web), the corresponding entitlement and credit balance is reconciled across platforms within 24 hours. 9. Intellectual Property
- Nevala and its brand, software, and service remain the sole property of Nevala.
- You retain all rights to the content you upload. Nevala processes your content only for as long as it takes to run the scan you requested and does not retain it afterward, so we do not ask you for any licence over your content beyond what is technically necessary to perform that scan.
- Uploaded media is deleted immediately after scan completion (with a 24-hour automatic purge as a backstop); page screenshots are never stored. Scan results (timecodes, labels, summaries) are shown to you during your session and are not stored afterward — we keep only the billing record of a scan, never its results — as described in our Privacy Policy.
10. AI Limitations and Disclaimers
Trigger detection uses AI and is not deterministic. Results may contain false positives and false negatives. The Service is not a substitute for personal review of media. We make no warranty that the Service will identify every instance of a phobia trigger. You assume final responsibility for your media-consumption decisions.
11. Not Medical Advice
Nevala is an accessibility tool. It is not a medical device, diagnostic tool, therapeutic intervention, or clinical screening product. It does not provide medical, psychological, or therapeutic advice, and it does not diagnose, treat, or cure any condition. If you are seeking treatment for a phobia, please consult a licensed mental health professional.
12. No Personal Profiling
Nevala does not perform facial recognition, does not extract or store face geometry, does not identify individuals, and does not create biometric templates or profiles. The Service classifies media content only; it does not profile individuals appearing in that content, perform biometric recognition, or make automated decisions about persons.
13. Third-Party Services
The Service relies on Google (Vertex AI for content scanning, Cloud Storage for temporary file staging, and the YouTube Data API for checking links), Paddle (payments), Vercel (hosting), Supabase (database and authentication), and Sentry (error tracking). Their respective terms of service and privacy policies apply to their portions of the Service. See Privacy Policy for links.
14. Termination
We may suspend or terminate your access for violations of these Terms. You may delete your account at any time. Unused credits at the time of your voluntary deletion are subject to our Refund Policy.
15. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of the Service is limited to the total amount you paid to Nevala in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law; and nothing in these Terms limits statutory consumer rights that cannot be waived.
16. Indemnification
To the extent permitted by applicable law, and except where you are a consumer using the Service for ordinary personal purposes, you agree to indemnify and hold Nevala harmless from third-party claims arising out of your unlawful use of the Service or out of content you submit in breach of these Terms. Nothing in this section limits any statutory rights you have as a consumer.
17. Dispute Resolution and Governing Law
Governing law and where you can sue us. This contract is governed by the laws of Georgia (Sakartvelo). But if you live in Ireland or another EU/EEA country, the law of your home country still protects you on top of Georgian law: you keep every consumer right that the law of your home country gives you — including, for Irish consumers, under the Consumer Rights Act 2022, S.I. 484/2013, the Consumer Protection Act 2007, and the General Data Protection Regulation. Those protections cannot be taken away by this contract.
You can bring any claim against us in the courts of your home country in the EU/EEA — for an Irish consumer, that means the Irish courts. We will only bring a claim against you in the courts of your home country. Nothing in this contract stops you from using a small claims procedure, an ADR or ECC-Net body, or your national consumer authority’s complaints process.
18. Changes to Terms
We may update these Terms for a valid reason — for example, to reflect changes in the law, in the Service’s features, or in how it is provided. We will give you at least 30 days’ notice of any material change and tell you the reason for it. If you do not agree to a material change, you may stop using the Service and close your account before the change takes effect, and any unused credits are handled under our Refund Policy. Continued use of the Service after the effective date constitutes acceptance.
